The African-American Civil Rights Movement is arguably the largest and most successful push towards toward change in American history. The movement was influenced by some of the biggest figures in American history as well, led by Martin Luther King Jr. and influenced by others such as president Kennedy and Johnson. Amongst the numerous protests and powerful speeches during the Civil Rights Movement perhaps the most prominent is the series of three marches in 1965 known today as the â€Å"Selma to Montgomery† marches. The Selma to Montgomery marches were a series of three marches from Selma to Alabama’s capitol in Alabama There were multiple goals and objectives of these marches but the most obvious was to make the largest impact possible with a nonviolent approach. In partnership, there are two or more people, who contribute to the capital of the business and share the profits (or losses) as per the partnership deed. All the partners work towards the growth of the business and hence provide a wider set of human capital which proves beneficial for a business. But even partnership has the clause of unlimited liability. And so, in case of a debt, the personal assets of the partners are contributed for payment of such debt. In the given case, the business of Jack, Jill, and Max of selling trucks is very successful and is growing strong. They are in need of a more appropriate structure. In this case, the first issue is whether Child Toys Pty Ltd has any corporate liability because of Bettys action. Vicarious liability is the liability which arises from the relationship of an agency, principal and a third party. In vicarious liability, the employer is held liable to the third party for an act done by the employee. Employers are also liable for the negligent acts and/or omissions by their employees during the tenure of employment. The person has to be an employee and not an independent contractor, as was distinguished in the case of Hollis v Vabu [2001] 207 CLR 21 (High Court of Australia, 2001). In one of the latest case of Blake v JR Perry Nominees Pty Ltd [2012] VSCA 122, the employer was held vicariously liable for the actions of its employees (Alderman, 2012). Further, the common law also holds the employers liable on the basis of qui facit per alium facit per se. This concept is parallel to the concept of vicarious liability. The Australian Consumer Law contains the provisions regarding the unfair practices which contain any deceptive or misleading conduct, unfair contracts and unconscionable conduct, product safety and information, product liability. Further, ACL, through its Section 18 forbids the conduct of business in a manner which misleads the consumer or is deceptive or misleading or is likely to result in a deception. Similar provisions are provided by the Fair Trading Act, 1987, in the matter of deceptive and misleading conduct of businesses. Remedies under these acts are provided with the objective of protection of the consumers and are awarded in the form of fines and damages. In the present case, Betty was a salesperson in Child Toys Supreme Ltd. Betty had promised some customers that the toys were safe and contained no harmful plastic chemicals. Here, a clear deception in the conduct of business is established. To further prove the deception in this case, a reference should be made to the case of Dib Group Pty Ltd v Ventouris Enterprises Pty Ltd [2011] (Burrows, 2014). Further, a child was seriously injured because of the harmful chemicals in the toys. This would give rise to a civil liability under the civil laws instead of the criminal laws. A deliberate evidence is absent in this case to hurt the child, as was held in case of Bradshaw v McEwans Pty Ltd (1951) 217 ALR 1 at 5 and later in case of Samaan bht Samaan v Kentucky Fried Chicken Pty Ltd[2012] NSWSC 381 (White and Latta, 2015). So here, Betty is liable for civil penalties as per the Part 2 of Civil Liabilities Act, 2002. Betty, being the employee of Child Toys, fulfills the criteria of vicarious liability and qui facit per alium facit per se. This means that Child Toys is liable for the acts of Betty and is responsible for remedies under the common law, ACL, Fair Trading Act, and Civil Liabilities Act (Latimer, 2012). So, from the above analysis of this case, it can be concluded that indeed it is the corporate liability of Child Toys for the deceptive conduct of Betty. The second issue in this case is the possible legal actions which can be taken by Child Toys Pty Ltd against the actions of Charles. Division 1 of the Corporations Act 2001 contains the general duties of an officer or employee of the company (Australasian Legal Information Institute, 2016). An officer or employee of the company should not use the position in the company, so as to gain an advantage for themselves or for someone else, and also have to ensure that the information is not used in a way which is detrimental to the company as a whole (Section 182). Section 183 contains that a person who is in possession of sensitive information, as a result of being an officer or employee of the company, regarding the company should not use this information so as to gain an advantage for themselves or for someone else and also have to ensure that the information is not used in a disadvantageous way for the company. A contravention of these sections invites civil penalties stated under the section 1317E of this Act. The Australian Contract Law is applicable on any contract which is drawn in Australia (Andrews, 2015). Contraventions to these laws provide remedies to the aggrieved party in form of monetary and equitable damages. Further, the Competition and Consumer Act, 2010 promotes competition and fair trading for protection of consumers so as to boost the wellbeing of Australians. Civil penalties are awarded for the contravention of the provisions of this act. In the given case, Charles had been an officer of the company and had access to the sensitive information relating to Child Toys. After his retirement, he used this sensitive information for the benefits of his new business. His employment contract clearly stated that he was not allowed to compete with Child Toys for a period of two years. He violated such contract and attracted not only the civil liabilities under the Australian Contract Law, but also as per the Competition and Consumer Act, 2010. He claims to be taking this money to buy extravagant gifts to woo Desdemona on Roderigo’s behalf, but he keeps the money for himself. â€Å"Iago, who hast had [Roderigo’s] purse/ As if the strings were [his]† is clearly taking advantage of the jealous suitor of Desdemona (I. i. -3). As Roderigo is threatening to drown himself, Iago says to him, â€Å"If the/ balance of our lives had not one scale of reason to poise/ another of sensuality, the blood and baseness of our/ natures would conduct us to most prepost’rous/ conclusions† (I. iii. 325-329). This is hypocritical of Iago because he is scolding Roderigo for letting emotions and desires take over his life, but Iago lets rage, jealous, and his thirst for revenge take over his life. As a result of the lack of happiness and success in his own life, Iago feels the need to destroy that of others. When Cassio is promoted to lieutenant, Iago conspires to have him fired by suggesting that he’s having an affair with Desdemona. When Othello marries Desdemona, Iago tries to turn Brabantio against his new son-in-law. All these things ar e costing taxpayers thousands of dollars each year, making it difficult for American citizens to find work, causing crime rate to go up in cities across America. Our prisons and jails are becoming overcrowded as America’s population both illegal and legal continues to grow. Some illegal immigrants are able to stay if they are are caught because they meet the requirements for DREAM. Dreamers is a term given to unauthorized immigrants who qualify for Obama’s DREAM ACT-DEVELOPMENT, RELIEF, and EDUCATION for ALIEN MINORS. Dreamers are both Mexican and non-Mexican illegal immigrants and they are found in almost every state in  the U.S. According to the American Immigrant Council the largest Dreamers population is found mostly in California and Texas. Under the Dream Act, Dreamers between the ages of 15 and 30 who have lived on American soil for at least five years in a row, are enrolled in high school or have a diploma or GED, no felony convictions, or served in the military are immediately eligible for â€Å"deferred action†. Dreamers between the ages of five and 14 will be eligible at some point if â€Å"deferred action† is still available. Only in America, can illegal immigrants open and own their own businesses. Dante Algheri’s poem, the Inferno, attempts to perfect the concept of Divine Justice. Main Christian religious ideals and Dante’s political views and past encompass the concept of Divine Justice. Dante, born in 1265 in Florence, Italy, belonged to a family intensely involved in the political scene at a time of upheaval and unrest. Dante augmented his political standing by holding several public offices at a time of political unrest, and further, exiled from Florence. Dante’s political beliefs and past reflect the essence and spirit of divine justice in the Inferno. At the opening of Canto III, inscribed at the gate of Hell, reveals it as a place constructed by Divine Justice, Omnipotence, and Love. â€Å"Through me the way into the suffering city†¦ Justice urged on my high artificer; my maker was divine authority, the highest wisdom, and the primal love†¦Ã¢â‚¬  (21). This inscription sets a religious tone, and implies that justice would be substantiated by strict doctrinal Christian values. While The Inferno, a strongly religious poem influenced by Christian morality, Dante incorporates his political ideals in his attempt to define Justice. Dante places numerous political figures through out the different levels of Hell. Farinata, the leader of the Gibellines in Florence, the party that opposed Dante’s Guelphs resides in the sixth level of Hell. Another Guelph, Brunetto Latini, Dante’s teacher at his university and a sodomite, resides in the seventh circle of Hell. Also, in the Seventh circle of Hell, Dante reveals his disdain for Florence, when he talks to three Florentine souls, expressing that arrogance reigns the damned city, â€Å"Newcomers to the city and quick gains have brought excess and arrogance to you, o Florence† (147). Dante reveals the corrupt political nature of Florence by placing numerous Florentine souls in Hell. More importantly, Dante reveals the epitome of injustice through the corruption and turmoil of Florence. While religion, a guiding force behind Dante’s vision of divine justice, Dante’s political views came to contradict important Christian doctrine and the Catholic Church. In the Eighth circle of Hell, Dante expresses his greatest criticism of the Catholic Church by placing Pope Nicholas III. Dante shows the Pope no pity, â€Å"stay as you are, for you are rightly punished,† (173) and further scorns all corrupt churchmen, â€Å"I’d utter words much heavier than these, because your avarice afflicts the world: it tramples on the good, lifts up the wicked. (173) Dante suggests a key factor to achieving justice, a separate but equal Church and state. In the ninth circle of Hell, Dante places the still living, Florentine souls Bocca defli Abata and Fra Alberigo, as traitors against their guests. Dante illustrates the worthiness of their punishment and the corruption they have caused in Florence, Ah, Genoese, a people strange to every constraint of custom, full o f all corruption, why have you not been driven from the world? For the foulest sprit of Romagna, I found one of you such that, for his acts, in soul he bathes already in Cocytus and up above appears alive, in body. (309) Dante expresses the intensity of the corruption in Florence, and demonstrates this by placing two Florentian souls in one of the worst levels of Hell. More importantly, by placing these souls in Hell prior to their physical death, Dante greatly contradicts orthodox Christian doctrine. More contradictory, in the absolute lowest level of Hell, Dante places Brutus and Cassius, who murdered Julius Caesar, next to Judas Iscariot who betrayed Christ. Dante equalizes both Caesar and Christ as benefactors. Just as Christ represents the perfect manifestation of religion, Caesar embodies the perfect manifestation of secular government. While Judas should clearly experience harsher punishment, based on Christian morality, he only experiences a slightly worse punishment than Brutus and Caissus. Clearly, Dante’s vision of morality unites both politics and religion. Dante’s political past with Florence immensely influences his writing in The Inferno. Dante repeatedly places Florentine souls in Hell, and further elaborates his political views and ideals, most notably, his view of a separate but equal Church and state. In the final level of hell Dante patently unites his political and religious views of moral justice by showing Lucifer and three greatest sinners of all time—Judas, the betrayer of Christ, and Cassius and Brutus, the betrayers of Julius Caesar. A former Marine and CPA, John Battaglia was well liked by his friends and family. He appeared to be a good guy- fun spirited and charming. That was what MaryJean Pearle thought when she married him, but on their wedding night, Battaglias dark side began to emerge. At first,  he would fly off the handle and throw a few curse words and insults at his new wife. Pearle did not like it, but she put up with it  because they shared more good times together than bad. The following year  their first daughter, Faith, was born and then Liberty, three years later. Now with a family to consider, Pearle tried even harder to make the marriage work. An Idyllic Life With Hidden Secrets Living in an upscale neighborhood in Dallas, the small family seemed to have an idyllic life. But inside the home, Battaglias violent episodes began happening more often. He verbally abused Pearle, screaming obscenities at her and calling her vile names.   As time went on, the verbal attacks lasted longer and in an effort to keep her family together, Pearle endured it. The girls adored their dad, who had always been a gentle and loving father to them, even though his temper tantrums that he unleashed on Pearle continued to increase. Then one night, his anger switched from verbally attacking Pearle to going after her physically. She was able to get away and call 911. Battaglia was placed on probation and although he was allowed to see the girls, he was not allowed to enter their home. The separation gave Pearle a chance to think and it did not take long for her to realize that after seven years of abuse and having her children exposed to a lot of it, that it was time to file for a divorce. Christmas 1999 On Christmas day in 1999, Pearle allowed Battaglia to come into the home so he could visit with the girls. The visit ended in the two of them arguing and Battaglia violently attacking Pearle. He beat her with full force on the back of her head as she tried to protect herself from the blows. Battaglia was arrested and charged with assault. He was put on two years probation and was forbidden to have contact with Pearle. He could also not visit his daughters for 30 days. When the 30 days ended, normal weekly visitation started back up and so did the verbal assaults toward his ex-wife. Rage and Resentment The divorce came through the following August, but that did not deter Battaglia from leaving obscene and often threatening messages on his ex-wifes phone. As the threats progressed, Pearle became more fearful that one day her ex-husband might really act on what he was saying, but the thought that he would ever hurt the girls did not enter her mind. Visitation between the girls and their father continued. After a particularly frightening call from Battaglia in April 2001, Pearle decided it was time to get help. She contacted her ex-husbands probation officer and reported that he had been making threatening calls, which was a violation of his parole.   A few weeks later, on May 2, Battaglia found out that his parole had been revoked and that he was probably going to be arrested for the calls that he made to his ex-wife and for testing positive for marijuana.  He was assured by a police officer that the warrant would not be executed in front of his children and that he could make arrangements with his lawyer to peacefully turn himself in. He was scheduled to have the girls over for dinner that same night and Pearle,  not knowing that Battaglia had any knowledge that she had reported him to his parole officer, dropped off the girls with him at the normal meeting place. A Daughters Cry Later that evening, Pearle received a message from one of her daughters. When she returned the call, Battaglia put the call on speakerphone, and told his daughter Faith to ask her mother, Why do you want Daddy to go to jail? Then Pearle heard her daughter screaming, No, Daddy, please dont, dont do it. Gunshots  followed the childs cry and then Battaglia screamed, Merry (profanity) Christmas, then there were more gunshots. Mary Jean Pearle hung up the phone and frantically called 911. After shooting 9-year-old Faith three times and 6-year-old Liberty five times Battaglia went to his office where he left one more message, but this time to his dead daughters. Goodnight my little babies, he said. I hope youre resting in a different place. I love you, and I wish that you had nothing to do with your mother. She was evil and vicious and stupid. I love you dearly. Then he met up with a girlfriend and went to a bar and then to a tattoo shop and had two red roses tattooed on his left arm in honor of his daughters that he had just murdered. Battaglia was arrested as he left the tattoo shop at 2 a.m. It took four officers to restrain and handcuff him. Officers took a fully loaded revolver from Battaglias truck after his arrest. Inside his apartment, police found several firearms and the automatic pistol used in the shootings laying on the kitchen floor. Autopsy Faith had three gunshot wounds, including a shot to her back which severed her spinal cord and ruptured her aorta, a contact shot to the back of her head which exited her forehead, and a shot to her shoulder. Either of the first two shots would have been rapidly fatal. Six-year-old Liberty had four gunshot wounds and a graze wound to the top of her head. One shot entered her back, severed her spinal cord, went through a lung, and lodged in her chest. After losing about one-third of her blood, she received a contact shot to her head which passed through her brain, exited her face, and was immediately fatal. A History of Abuse is Revealed In less than 20 minutes of deliberation, the jury found Battaglia guilty of murder.   During the  punishment phase of the  trial, Battaglias first wife,  Michelle Gheddi, testified about the abuse she had suffered during their marriage that lasted from 1985 to 1987, and then after their divorce. Twice  Battaglia was physically violent toward Gheddis son from a previous marriage. Once when Ms. Gheddi was traveling with  Battaglia  in the car, he became angry at some other motorists and tried to reach for a gun he had in the car. They separated after an incident in which Battaglia struck Gheddi while she was holding their daughter Kristy, causing her to drop the child. After the separation, Battaglia stalked Gheddi,  watched her through the windows of her home, followed her in his car and somehow managed to tap her phone line.  He called Gheddis employers and creditors and made false statements about her. He threatened to kill himself and her, and once described to her in detail how he planned to cut her up and kill her with a knife. One night Gheddi woke up sometime after midnight to find her estranged husband standing over her bed and holding her shoulders down. He wanted to have sex, but she refused. Later she filed a police report about the incident. In January of 1987, Battaglia spent several days in jail after throwing a rock at Gheddi through her car window. After his release, things seemed to improve, but for only for a few months. Gheddi again filed charges against Battaglia after two more violent episodes.  Battaglia begged her to drop the charges, but she refused. Later that day, he approached Gheddi outside of her sons school. Smiling as he came toward her, he told her, If Im going back to jail, Im going to make it worth my while. He then beat Gheddi until she lost consciousness, breaking her nose and dislocating her jaw. After she got out of the hospital, he threatened to do the same to her son, so she moved to Louisiana At noon on the day that Faith and Liberty were killed,  Battaglia left a message on Gheddis  answering machine saying that maybe Pearl should lose her kids. He left another message later that evening for Kristy, telling her that he was sending her money for college and to use it wisely. Psychiatric Testimony Four forensic psychiatrists testified about  Battaglias mental state when he murdered his children.  They all agreed that Battaglia suffered from bipolar disorder, and all but one of the doctors thought that with the proper medication and under a controlled environment, he was a low risk for future criminal violence. All of the doctors testified that Battaglia knew what he was doing when he murdered his daughters. Death Sentence On May 1, 2002, after deliberating for close to seven hours, the jury agreed with the prosecutors who felt that the murders were a result of Battaglia seeking revenge because of his ex-wifes actions and that he could pose a possible threat in the future.  Battaglia, who was 46 years old at the time, was sentenced to death  by lethal injection. Best Little Friends Referring to his daughters as his best little friends, Battaglia told The Dallas Morning News that he did not feel like he had killed his daughters and that he was, a little bit in the blank about what happened. Medicines are manufactured in several forms and can be administered by different routes. According to the form of the medications there are different requirements and equipment for their administration and storage (Burton and Donaldson 2007). This essay will focus on the administration of oral medicines, the standards and the legal requirements for their safe administration. The National Patient Safety Agency (NPSA) defines patient safety as a process which involves identification, analysis and management of risks and incidents, including medication errors so potential or actual harm to patients can be prevented or minimised. Medication errors have a significant impact on patients, their families and health professionals involved. They can compromise patients safety and result in actual harm to patients. A total of 72,482 medication errors of which 14,111 caused harm of various extents to patients and 37 resulted in death were reported to the NPSA (2009) in one year. The same report showed that nearly half of the incidents were concerned with administration of medicines. Another report by the Department of Health (2004) estimated the cost of medication errors in NHS hospitals between  £200-400 million per year. Therefore it is vital that nurses adopt safe, methodical and skilled approach to administration of medicines. LEGAL The management of all medicines in the United Kingdom is governed by several legislations, the Standards for Medicine Management (2008) and the Standards of conduct, performance and ethics issued by the NMC (2008). The Standards outline the nurses responsibilities in relation to the current UK legislations. Burton Donaldson (2007) summarise these legislations in the latest edition of the Foundations for Nursing Practice. The Medicines Act (1968) regulates the requirements by which medicines are manufactured, prescribed and administered. The Medicines Act (1968) also classifies medicines into four categories which are Prescription only medicines (POMs), Pharmacy only medicines (Ps), General sales medicines (GSLs) and Control drugs (CDs).The Misuse of Drugs Act (1971) and the Misuse of Drugs Regulations (1985) provide the legal framework for the management of the controlled drugs and differentiate medicines according to the level of harm they may cause. The Mental Capacity Act (2005) provides the foundations for care delivery including medicine administration to people who lack the ability to make informed decisions. For Scotland these foundations are contained within The Mental Health (Care and Treatment) (Scotland) Act (2003) and The Adults with Incapacity (Scotland) Act (2000). These regulations are in place to assist and guide nurses and are fundamental in protecting patient safety. Anex1 of the Standards for Medicine Management (NMC 2008) specifies the nurses responsibility to comply with these regulations. However the administration of medication is not solely a mechanistic task to be performed and requires more than just following written instructions (NMC 2004). In respect to oral medicines and their administration the nurse should take a person centred approach and assess and assist each patient individually according to patients general condition. Kelly and Wright (2009) draw attention on the high number of medication administration errors in patients with swallowing difficulties, where physiological abnormalities can lead to difficulties in swallowing of liquids or tablets. Griffith (2005) suggests that alternative form of medicines should be considered if patients have difficulties swallowing tablets. The nurses responsibility in this respect is to perform the initial and ongoing assessment of patients condition to establish the suitability of certain type of oral medicine and the ability of the patient to take this medicine (NMC 2008). Physical or mental health conditions could also have an impact on the medication compliance by patients leading to crushing, mixing or disguising medicines in food or drink (Kelly Wright 2009). The Department of Health (2010) and The National Prescribing Centre (2010) outline the parameters and principles for safe mixing of medicines and the nurses role in this relation. Following these principles when nurses consider mixing of medicines they should always act in line with local policies, consult a pharmacist and obtain written instructions and also obtain consent from patients. Crushing and mixing of medicines without a careful assessment and justification could present safety risks for patients and nurses (Paparella 2010) because of their chemical formulations. Examples of these are the enteric coated tablets, slow released formulations and products containing carcinogenic substances. Crushing or splitting of these medicines may lead to undesirable effects for example unintended rapid absorption. Griffith (2005) points out the legal consequences of crushing tablets. If crushing of oral formulation results in harm for the patient the nurse responsible will be liable for negligence. Paparella (2010) suggests simple steps such as careful consideration whether a tablet is safe to crush and consultations with pharmacist could significantly minimise the risk for patients and nurses. It is also essential that nurses have a sufficient level of knowledge of how medicines interact with the human body in order to be able to observe if they achieve the desired therape utic effect and to avoid any adverse reactions (NMC 2008). Covert administration of medicines represents not only safety risks to patients but also has legal and ethical aspects which nurses have to consider before making a decision for such action (Griffith 2007). Although most of the nurses do not prescribe medicines it has been found that the administration of a wrong dose of medicine causes the largest number of deaths and serious harm to patients, followed by the administration of wrong medicine and omitted or delayed medicine (NPSA 2009). What you wear defines who you are. Fashion is an enormous icon in our society. It is practically the thing we can never go without. We make our very first impression by what we wear not by our personalities. They say you are what you eat but truly you are what you wear and fashion has provided us with a little something to define everyone. There are so many styles of fashion: Goth, Chic, Prep, Hippies etc. Every style has its own description so why would we not be classified into that style and its description that fits us perfectly.What we wear can also make it easy for us to identify people and whether they are ho we want to socialism with, I. E. An individual wearing all Goth (black colored clothing) would not befriend someone who wears preppy clothing (beige colored clothing). Fashion plays an even bigger role when it comes to uniforms; do you that think without uniforms we would be able to identify the authority on our streets? Do you think that we would have the same respect fo r a doctor in a Shares and t-shirt?A number of religions prescribed a specific clothing style aside for us. Our designers are creative geniuses in all aspects. There is no obvious reason as to why we buy the yep of wardrobes we do. It could be to make a statement to get noticed, I. E. Prostitutes are easy to spot with their provocative style of fashion. Others might Just be copying the current trend – this makes it hard for to prove the theory of â€Å"what you wear defines you† – but then we could Judge these individuals as those who have not found a style that defines them.We wear clothes to beautify ourselves to attract the attention we seek. We dress a certain way that mirrors the mood we are in, happy = bright colored clothing & sad = grey and baggy clothing, there are many seasons as to why we take hours Just deciding what to wear because it is essential in our lives to create the correct mood, persona, background, etc. Why wouldn't one agree with this sta tement?We choose the clothes we wear by the way we want to be perceived by others, fact. Several options about how could one not define ones self with it. They say don't Judge a book by its cover but in the end we still go ahead and judge this is the same for fashion which is why we make sure we always look good. He tells his sad miserable story about his mother several times in Russia and especially in America, and it always benefits him. David also tells of his first honest wages, suggesting that the begging that he did in the past was dishonest: He writes, And when I received my first wages-the first money I had ever earned by the work of my hands-it seemed as if it were the first money I had ever earned honestly. David was very alone after his mother died and lost an interest in his religious studies. He fills this hole and his hunger for knowledge by going to America.
